These Terms and Conditions ("Terms") govern your use of the GoldMyn platform operated by Yellowbrick Ventures Private Limited. By accessing or using our services, you agree to be bound by these Terms.

1. About GoldMyn

GoldMyn is a technology platform that provides two primary services: (a) facilitating digital gold investments through our partner Augmont Goldtech Private Limited, and (b) aggregating gold purchase plans offered by partnered jewellers. We act solely as a technology intermediary and do not directly handle gold transactions, storage, or delivery.

2. Services Overview

Digital Gold Services

We facilitate digital gold investments with a minimum purchase of ₹50 for 99.9% pure gold. All digital gold transactions are processed and managed by Augmont Goldtech Private Limited. PAN verification is mandatory for all users, and purchased gold cannot be sold or redeemed for 72 hours after purchase.

Gold Purchase Plans (GPPs)

We aggregate systematic gold accumulation plans from partnered jewellers with a minimum monthly contribution of ₹1,000. Each plan requires separate KYC completion including Aadhaar e-signature verification. Plan terms, benefits, and redemption policies are governed entirely by the respective jeweller partners.

3. User Eligibility and Requirements

Users must be 18 years or older with legal capacity to enter binding contracts. Valid KYC documentation including Aadhaar and PAN cards is required. Users must provide accurate personal information and are prohibited from using the platform if registered under the Goods and Services Tax Act, 2017. Any changes to GST registration status must be promptly disclosed.

4. User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and ensuring all provided information is accurate and up-to-date. All transactions conducted through your account are your responsibility. You must comply with applicable laws and regulations, including tax obligations arising from platform transactions.

5. Platform Limitations and Disclaimers

GoldMyn operates as a technology facilitator only and assumes no responsibility for gold quality, purity, storage, delivery, or pricing. The platform is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service or error-free operation. Third-party services, including payment gateways and partner jewellers, are subject to their own terms and limitations.

6. Transaction Terms

All orders placed through the platform are final and irrevocable unless specifically permitted otherwise. Payment must be made through approved methods only. Applicable taxes and charges will be levied as per government regulations. Live pricing is subject to market fluctuations and may differ from open market rates.

7. Liability Limitations

Our liability is limited to the maximum extent permitted by law. We are not liable for indirect, incidental, or consequential damages, including loss of profits or business opportunities. Users acknowledge that transactions are conducted at their own risk, and we disclaim responsibility for technical failures, unauthorised access, or third-party service disruptions.

8. Indemnification

Users agree to indemnify and hold harmless GoldMyn and its affiliates from any claims, damages, or expenses arising from breach of these Terms, unauthorised use of the platform, inaccurate information provided, or disputes with third parties.

9. Privacy and Data Protection

Your personal information is collected, processed, and stored in accordance with our Privacy Policy, which forms an integral part of these Terms. By using our services, you consent to our data handling practices as outlined in the Privacy Policy.

10. Termination

We reserve the right to suspend or terminate user access without prior notice for violation of these Terms or for business, legal, or compliance reasons. Termination does not affect accrued rights and obligations. Users may discontinue use of the platform at any time.

11. Modifications

We may modify these Terms at any time without prior notice. Updated Terms will be posted on our platform, and continued use constitutes acceptance of such modifications. Users are advised to review Terms periodically.

12. Governing Law and Jurisdiction

These Terms are governed by Indian law, and any disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka. Parties agree to attempt amicable settlement for at least 15 days before initiating legal proceedings.

13. Force Majeure

GoldMyn shall not be liable for delays or failures in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, technical failures, or cyber incidents.

14. Electronic Communications

All communications will be provided electronically through email, SMS, or in-app notifications. Such communications are deemed legally valid and equivalent to written documents. Users may opt out of non-essential communications but must receive mandatory transactional notifications.
